Definitions

1. "We"/ "Us" / "Our" refers to The SirQo Group
2. "Website" refers to The Sirqo Group websites www.motodeal.com.ph/, www.autodeal.com.ph/, www.truckdeal.com.ph/ and all related websites and platforms
3. We collect the IP address of the computer or device which is used to access our Website.
4. "You" / "Your" refers to the user of the Website.
5. Insurance Provider - refers to a licensed insurance company engaging in electronic commerce directly with consumers for the issuance of an insurance contract or to provide insurance services. lt may include licensed intermediaries as may be authorized by the insurance company to conduct electronic commerce of its insurance policies and mutual benefit association in so far as it concerns the provision of insurance coverage to its members

Access

Access to the Website is subject to these terms and conditions. Upon accessing the Website on this and each subsequent occasion thereafter you will be deemed to have accepted all of the terms and conditions that apply to its use and to the facilities and services provided by it, from time to time. We reserve the right to alter or amend these terms and conditions without prior notice. Your continued use of the Website after the changes are posted online shall constitute acceptance of the new terms and conditions. We reserve the right to withdraw or amend the service we provide on our Website without notice. We will not be held liable if for any reason our Website is unavailable at any time or for any period. At times, we may restrict access to some parts of our Website, or our entire Website, to users who have registered with us.

General Provisions

We encourage all users to act honestly and honorably when using features of the Website.

Nevertheless, the following general provisions should be taken into consideration by all users before accessing the Website:

1. Before purchasing a vehicle or other goods or services you’ve been referred to through the Website, you should confirm with the vendor any information (including but not limited to the price of goods) that is important to your decision-making process. We will not be held responsible for, nor guarantee the performance of, any such vehicles, goods or services.
2. Information about a particular vehicle deal published on our Website is supplied by the manufacturer or distributor, not by us. The price and other terms of any sale remain the subject to direct negotiation between the buyer and seller. The prices listed on the Website often exclude sales tax, finance charges, title, license, regulatory, dealer documentary, emission testing, and compliance fees, all of which may be added to the listed price to arrive at the final sale price of a particular vehicle.
3. We accept no responsibility for the actions or omissions of users of the Website. We will not be held responsible for verifying information sellers supply nor guarantee the vehicles they offer.
4. You may not use our Website to promote, without our prior written permission, any other website, product or service.
5. Though we do not take responsibility for monitoring transactions that originate through a deal on our Website, we may from time to time perform random quality assurance tests to confirm that those users who offer vehicles for sale over the Website are prepared to sell the vehicles at the prices at and on the other terms on which, they advertise them.

Online Reservations (Buy Now) Feature

The AutoDeal Buy Now / Online Reservation feature is an online car-buying facility that enables you to begin the car-buying process with ease on the AutoDeal.com.ph website.

By using this feature you agree to the terms as follows.

1. All Online Reservations are valid for thirty (30) days after payment.
2. Reservations are available with select partner car dealerships only.
3. Online Reservations do not guarantee auto loan approval.
4. Reservation payments will be deducted from the final balance of the vehicle.
5. All final payments (whether by cash, cheque or auto loan) must be facilitated with the dealership that was specified when you submitted your reservation.
6. Reservation payments are non-transferrable.
7. Final balance of payment must be made via cash, cheque or auto loan with the dealership specified in your reservation and in accordance with their payment terms.
8. Reservation payments are valid for up to thirty (30) days. This means that you must be in the process of completing your transaction before this window expires. Reservations that remain inactive after thirty (30) days will be subject to being canceled. If you have made a reservation through a promotion and down payment was not made before the promo expiry date, then discounts and special financing may be subject to change. In either of the above cases you can claim a refund. You may contact refunds@autodeal.com.ph for more information on claiming refunds.
9. Reservation payments are non-refundable after the completion of the vehicle sale at the dealerships. For information on future refunds after purchase, we advise to discuss with your designated dealership.
10. Designated color options are provided as a guide to preference only. We do not fully guarantee color availability at our partner dealerships.

Auto Insurance

Apply for your Auto Insurance online and receive your policy through email within the next business day.

By using this feature, you agree to the terms as follows:

4. Broker of Record - By Completing the Payment Process, you agree to assign the Insurance Provider, ABOVE, to represent and manage your policy, following existing terms and conditions for designated agents of the Insurance Company the above intermediary is duly authorized under.
5. Refunds and Cancellation shall follow the corresponding process and timeline for the specific Insurance Company a policy is under.

Content

1. You agree that you will not use, reproduce and/or publish any material comprising the results of searches made from our database of deals, new cars, new motorcycles, new trucks, insurance services, car repair services, car rental service, car financing services and/or any other products or services found on the Website. In particular, you must not use the contact details provided by advertisers of vehicles to contact such advertisers other than in connection with a genuine inquiry relating to the deal or vehicle in question.
2. All deals and related information is posted by corporate clients and other third parties. Accordingly, technical inaccuracies, omissions and other incorrect information may appear on the Website from time to time. We actively invite all users to bring to our attention any material inaccuracy on the Website by reporting it to us at info@autodeal.com.ph. At the same time we accept no responsibility or liability for failing to keep the information on the Website up to date and free of technical inaccuracies, omissions and other incorrect information.
3. YOU HEREBY INDEMNIFY US AND HOLD US HARMLESS AGAINST ANY LIABILITY, LOSS OR DAMAGE YOU MAY SUFFER ARISING FROM ERRORS, OMISSION OR INACCURACY ON THE WEBSITE.
4. The information contained on the Website is only for information purposes. The material on the Website does not constitute direct advice and you should not rely on any material on the Website to make (or refrain from making) any decision or take (or refrain from taking) any action.
5. We give no warranties, conditions, guarantees or representations, expressing or
   • he completeness or accuracy of the advice and information contained on the Website or any website to which it is linked;
   • the completeness of the results of any search of our database.
6. The Website publishes advertisements placed by third parties to advertise their vehicle and other goods and/or services. We do not own the vehicles or goods advertised for sale on the Website and have no liability for any losses that you may incur as a result of purchasing a vehicle, goods and/or any services advertised by third parties. If you choose to purchase a vehicle, goods and/or services advertised for sale by third parties, the contract will be between you and the third-party advertiser and not with us.
7. We reserve the right to remove any content we believe is illegal or offensive in any manner and to ban any user from accessing the Website regardless of any active advertising that the user may have on the Website. In this regard, and without limiting our general right aforesaid, we reserve the right to delete any and all posts, advertisements, reply, comment and/or feedback that in our opinion may violate the rules set forth below:
   • No adult content or any sexual materials
   • No offensive materials depicting violence
   • No foul, offensive or improper language
   • No racist, hateful, inflammatory or flaming comments
   • No offering of services that are prohibited by law
   • Avoid confusing, deceptive and/or misleading information
   • No reference, except for those considered as “fair use” under existing laws, rules and regulations, to materials protected by copyright and/or intellectual property laws without prior permission from the rightful owner(s).

All intellectual property rights, including copyright, in the content of the Website, excluding the photographs of any vehicles displayed on the Website, and all rights in our database of vehicle and other product listings, is owned by us, save for the trademarks, names, and logos owned by third parties (“Third Party IP”).
9. Nothing in these terms and conditions in any way confers on you any license or right to any of the aforesaid intellectual property rights.
10. Except as expressly permitted by these terms and conditions, you may not copy, reproduce, publish, download, distribute, republish, transmit, display, adapt, alter, create derivative works or otherwise extract or reuse any content of the Website. In particular, you must not cache any of the contents for access by third parties nor mirror or frame any of the content of the Website without our express written permission.
11. If you are the owner of intellectual property and believe your intellectual property rights have been infringed by a listing posted or distributed via the Website, please notify us by sending an email to info@autodeal.com.ph.

Owner Reviews

1. Owner reviews submitted to the Website will be checked for compliance with the content standards set out in these Rules before publication. We will try to publish as many Reviews as we can but we cannot guarantee that all Reviews will be published. We also cannot guarantee how quickly Reviews will be posted on the Website.
2. Although Owner Reviews are checked prior to publication, we are under no obligation to you or to any other person to oversee, monitor or moderate the Website or any other service we provide on the Website and we may stop moderating the Website at any time. You are solely responsible for your Reviews. We are not responsible as author, editor or publisher for any Review submitted to the Website and we expressly exclude our liability for any loss or damage arising from use of the Website in contravention of these Rules. We reserve the right to promptly remove, or to disable access to, any Review which we deem to be potentially defamatory of any person, unlawful, inappropriate, in violation of any third party rights or otherwise in breach of these Rules.
3. These Content Standards apply to all Owner Reviews and must be complied with. We will determine, at our discretion, whether a Review breaches the Content Standards.
   
   A Review must:
   • be accurate (where it states facts);
   • be genuinely held (where it states opinions);
   • be relevant.
   A Review must not:
   • be defamatory of any person or mention any individuals or small organisations including but not limited to car dealerships and mechanics. Your review is of a car, not of the service you have received from those you have dealt with;
   • contain any strong profanity or be obscene, offensive, threatening, inflammatory, abusive, hateful, racist, anti-religious or sexually graphic;
   • be in any way discriminatory or promote discrimination of any kind;
   • infringe any copyright (i.e. belong to someone else) or infringe any database right, trade marks or other rights of any other person;
   • breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
   • impersonate any person or misrepresent your identity or affiliation with any person;
   • be likely to harass, upset, embarrass, alarm or annoy any other person;
   • contain any advertising (including any adverts on the Website) or promote any goods or services or attempt to make a commercial gain;
   • contain any links or URLs to other websites;
   • contain any spam;
4. Other than personally identifiable information which is covered by our Privacy Policy, any Owner Reviews you transmit or post to the Website shall be considered non-confidential.
5. You grant to us a non-exclusive licence to freely use that Owner Review and to freely use, edit, alter, reproduce, publish and/or distribute the material contained in your Review. This licence is free of charge, perpetual and capable of sub-licence. We may exercise all copyright and publicity rights in the material contained in your Review in all jurisdictions to their full extent and for the full period for which any such rights exist in that material.
6. Failure to comply with these Rules constitutes a material breach of the terms of use on which you are permitted to use the Website and to submit Reviews. Where we consider, at our sole discretion, that a breach of these Rules has occurred or that the Website is being used in a manner that we consider to be inappropriate, we may take such action as we deem appropriate which includes (without limitation) the following action with or without notice:
   • removal of any and all Owner Reviews posted by you to the Website;
   • We exclude our liability for any action we may take in response to a breach of these Rules.
7. If you wish to complain about any Owner Review posted to the Website, please email us at info@autodeal.com.ph and give us as much information as possible as to why you think the Owner Review should be removed from the Website.

AutoDeal Coupon Terms

1. AutoDeal Coupons are valid for a limited time only.
2. AutoDeal reserves the right to modify or cancel coupons at any time.
3. The coupon may only be used at the dealer outlets noted above and is subject to the dealer’s usual terms and conditions of sale.
4. The coupon may only be availed by the individual it is registered to
5. The deal is limited to one coupon per customer.
6. The deal is good while supplies last.
7. Coupons are void if restricted or prohibited by law.
8. If you refund any items purchased with a coupon, the coupon discount or value may be subtracted from the return credit.
9. The dealer reserves the right to cancel coupons at any time.
10. Each coupon is identified by a Coupon Code and has different requirements and rewards - all requirements stated on the coupon must be met to receive the discount.
11. A coupon cannot be converted to cash.
12. Only one coupon can be used per sale.

Used Cars

1. AutoDeal's Used Car section is intended for Used Car Dealers and Private Sellers only. All used, repossessed, and certified pre-owned cars listed are sold on an “as-is” and “as available” basis unless stated otherwise.
2. We may ask you for additional information about the vehicle, such as images, registration details, and proof of ownership before we verify and publish the listing.
3. We have no obligation to provide a refund for listings, that in our reasonable opinion, has deceptive or misleading content.

Disclaimer of Warranties, Limitation of Liability & Indemnification

1. THE MATERIAL DISPLAYED ON OUR WEBSITE IS PROVIDED WITHOUT GUARANTEES, CONDITIONS OR WARRANTIES AS TO ITS ACCURACY OR FITNESS FOR PURPOSE. TO THE EXTENT PERMITTED BY LAW, WE HEREBY EXPRESS EXCLUDE:

Links To Other Sites

To gain access to certain services on the Website you will need to register. During the registration process, you will be given a password. You agree that the information supplied with your registration will be truthful, accurate and complete. You also agree that you will not attempt to register in the name of any other person. All personal information supplied by you as part of the registration process will be protected and used according to the terms of our Privacy Policy.

Final Remarks

1. The terms and conditions together with our Privacy Policy and Refund Policy, as amended and/or updated by us from time to time, contain the entire agreement and understanding between the parties relating to your use of the Website.
2. The terms and conditions shall be governed by the law of the Philippines and you hereby submit to the exclusive jurisdiction of the courts of the Philippines.
